Hi All,
On the 9th Aug 2022, I won a case against HMRC/BorderForce about the seizure of a Piper 150cm Small Breast Akira doll, in that she has now been designated as a mature female doll.
It is a delight to have her back on the website as she is super popular, and for good reason.
The case was a shambles, but it is what it is, and I think BorderForce have never had a true contender to their supremacy over dolls.
They seized the doll in December 2019, and I had to battle to contest this, as they deliberately did not communicate to me this until the window of opportuntity to complain was almost up.
I complained in a legal sense, to make this happen, and the complaint was made.
Covid happened, so after multiple delays/adjournments a court case was fixed in stone.
As it happened this was a day when we had huge gale force winds where building were being damaged and a magistrate could not make it to court - so hence another adjounrment and more costs.
Another court case was arranged, and when we turned up for court we found out that morning that the local police had destroyed the doll/evidence, so we argued to have the case thrown out due to lack of evidence/incompetence.
The magistrate did not agree with us so the case went on.
Another date was set (more costs - I think BF were trying to bankrupt me, but in for a penny, in for a pound - I was going to see this through) and we made our arguments:
There was much more, and I will ask for the court transcription, and we will be able to see each detail in minutae.
The Magistrate agreed with EVERY point that we made, and disregarded everything that BF had said.
So judgement was made in our favour, although we did not get costs, due to the fact that the BF officer followed directives set out by BF.
I'm not bitter over the costs because the judgement is worth more than money.
So history will remember the victors only, and that is US!
